General terms and conditions of WebSpace Hosting B.V.

Article 1: Definitions

In these terms and conditions, the terms below mean the following:

  • Account: A user interface that, after entering login credentials, gives the customer access to request, manage, and configure our services. This also includes access to stored configurations and files.
  • General terms and conditions: This document, which contains the basic requirements for our services.
  • Additional conditions: Specific terms and conditions which, in addition to these General Terms and Conditions, may apply to certain services. This may include third-party terms and conditions, a Service Level Agreement (SLA), or a Processor Agreement.
  • Consumer: A customer acting as a natural person and not in the exercise of a profession or business.
  • Services: All products and/or services provided by WebSpace Hosting B.V. to the customer on the basis of an agreement.
  • Confidential Information: Any information marked as confidential or to be considered as such by the receiving party. The content of any agreement between us and the customer is considered confidential.

Article 2: Applicability

  • These General Terms and Conditions apply to all offers, services, and agreements between WebSpace Hosting B.V. and our customers, unless otherwise agreed in writing.
  • By purchasing a service from us, you agree to these Terms and Conditions.
  • We may change these terms and conditions. For significant changes, we will inform our customers at least one month in advance. Minor changes may take effect immediately.

Article 3: The Account

  • Customers access their account with a self-selected password. It is the customer's responsibility to choose a strong password and keep it secret.
  • The account provides access to manage services, including a digital wallet for making payments. Customers are responsible for maintaining sufficient balance.

Article 4: Obligations of WebSpace Hosting B.V.

  • We undertake to provide the services purchased to the best of our ability and according to the specifications agreed in the agreement.
  • If service is interrupted due to unforeseen circumstances, we aim to restore it as soon as possible.

Article 5: Customer obligations

  • The customer must provide all necessary cooperation and supply correct and complete information for the performance of the service.
  • Misuse of the services, such as distributing illegal content, is prohibited and may result in immediate termination of the service.

Article 6: Payment and Rates

  • Rates for our services are clearly communicated prior to the agreement. Payments should be made according to the agreed deadlines.
  • If payment is not made on time, we reserve the right to suspend services until payment is made.

Article 7: Liability and Indemnity

  • WebSpace Hosting B.V. limits its liability to direct damage caused by gross negligence or intent on our part. Liability for indirect damages, including lost profits or data loss, is excluded.
  • The customer indemnifies WebSpace Hosting B.V. against all third-party claims arising from the use of the services, unless such claims are directly attributable to gross negligence or intent on our part.

Article 8: Termination and Termination

  • Agreements may be terminated by either party subject to the agreed notice period.
  • Upon termination of the service, the customer should take care of securing his data himself.

Article 9: Final provisions

  • These General Terms and Conditions are governed by Dutch law.
  • Disputes are preferably resolved by mutual agreement. If this is not possible, the dispute will be submitted to the competent court in the Netherlands.
